Terms of Service

These Terms of Service ("Terms") are an agreement between you and Dominion Technologies, LLC ("we", "us") and govern your use of Songlace (the "Service"). By creating an account or placing an order you agree to these Terms.
1. The Service
Songlace creates personalized, original songs (and, for some packages, lyric or photo videos) from the story and details you give us. Our team writes and produces every song using professional music tools, including AI-assisted production, and a person reviews every song before it is delivered.
2. Your account
You must provide accurate information, keep your password secure and be at least 18 years old. You are responsible for all activity under your account. Tell us promptly at hello@songlace.com if you suspect unauthorized access.
3. What you send us
You keep ownership of the story, names, photos and other material you send us ("Your Content"). You confirm that you have the right to share it with us, that photos you upload are yours or used with permission, and that Your Content does not infringe anyone's rights or include anything unlawful, hateful or harassing. Please don't ask us to use lyrics, melodies or recordings by other artists — every song we make is original. You grant us a limited license to use Your Content solely to make and deliver your order.
4. Orders, prices and payment
Prices are shown in US dollars before you pay and are charged once, through our payment processor (Stripe). There is no subscription. Rush delivery is an optional extra fee shown on the order form.
5. Delivery
Our delivery target is within 72 hours of payment for standard orders and within 24 hours for rush orders. These are targets, not guarantees; if we expect to miss one we'll tell you. We deliver by email with a link to your private order page, where you can listen to and download your files, and a private gift page link you may share.
6. Revisions
Each order includes the revision rounds shown for its package (2 rounds, or 3 with Premium Memory Video), requested from your order page. Revisions cover changes to the song we made from your story — for example a word, a line, a name's pronunciation or the overall feel. A completely different story or occasion is a new order.
7. Refunds
Our refund policy is part of these Terms: see Refund policy.
8. Your license to the song
When your order is paid and delivered, we grant you a personal, non-exclusive, worldwide, perpetual license to keep, play, perform at private events, share with friends and family, and post on your personal social media accounts the song and videos we made for you. You may not sell, license, distribute commercially, register with a content-identification or royalty service, or use the song in advertising without our written permission. We keep the copyright in the music and lyrics. We will only use your song as a public sample, or quote your feedback, with your permission.
9. Gift pages
Gift pages are private links that are not listed in search engines. Anyone you give the link to can open the page, so share it only with people you trust. You can ask us to disable a gift link at any time.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, except where such warranties can't be excluded by law.
11. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us for the order the claim relates to, and we are not liable for indirect, incidental, special, consequential or punitive damages.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or to comply with law. Sections that by their nature should survive termination will survive.
13. Governing law
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law rules, and disputes will be resolved in the courts located there.
14. Changes
We may update these Terms. If changes are material we will notify you by email at least 14 days before they take effect. Orders already placed stay under the Terms in effect when you ordered.
